Talk to an Immigration Attorney

Mariposa Legal provides free legal consultations to individuals who are detained. A Mariposa Legal staff member will speak with the detained individual and family member(s) or friends and ask questions to determine (1) whether the detained person is eligible to apply for bond (release from detention after paying an amount set by an Immigration Judge) or request humanitarian parole; (2) whether the detained person has any “relief” from deportation; and (3) whether Mariposa Legal can help with any of the individual’s legal needs.

Legal consultations are available Mondays through Fridays between 1-5pm at 317-426-0617 (call or text). Consultations will resume December 1, 2021.

Note: if a family member or friend is detained, if you can provide Mariposa Legal with the full name of the person detained, their A# (immigration number), and what facility they are detained at, we can set up an attorney call which will not require them to pay for a phone call from the detention facility.

Requests for Bond / Parole

Some individuals detained in the custody of Immigration & Customs Enforcement (ICE) are eligible to request a bond before an Immigration Judge which allows them to be released and continue their immigration case before the non-detained immigration court. This allows individuals to return to their families, communities, jobs, and schooling rather than fight their cases from detention.

Bond hearings before the Chicago Immigration Court usually happen between 2-4 weeks after a person is detained so it is important to contact Mariposa Legal quickly after a person is detained. This allows for the most amount of time to speak with the detained individual and their family members and gather documentation to allow for strong representation at the bond hearing. Mariposa Legal provides bond representation on a sliding fee scale based on the income of the detained individual’s family unit.

In certain circumstances, individuals who are not bond eligible may be eligible to request humanitarian parole directly from ICE. Mariposa Legal also works with detained individuals and families to prepare humanitarian parole requests on a sliding fee scale based on the income of the detained individual’s family unit.

Representation for Detained Immigration Court Hearings

Many individuals who are detained in ICE custody will be issued a document called a Notice to Appear (“NTA”) and be given a date for a detained hearing with an Immigration Judge. If a person (1) is not eligible for bond, (2) is not granted bond or parole, or (3) cannot pay their bond, they will need to fight their case before the detained Immigration Court.

Mariposa Legal provides representation before the detained Immigration Court on a variety of forms of relief, ranging from cancellation of removal, refugee waivers (209(c)), adjustment of status, as well as asylum, withholding of removal and protection under the Convention against Torture. Mariposa Legal understands that the continued detention of an individual can cause financial stress on families and communities and works with families to provide representation on a sliding fee scale and brainstorm payment plans that are workable for Indiana families.
